No charges filed against cops in fatal police shooting

AP  Eyewitness NewsNEW BRUNSWICK -- Outraged family members met with a New Jersey prosecutor Friday after a grand jury declined to file charges in a fatal police shooting in New Brunswick.

Middlesex County Prosecutor Bruce Kaplan announced Thursday the panel decided not to indict police officers Brad Berdel and Daniel Mazan in the shooting death of 46-year-old Barry Deloatch.

Prosecutors say Deloatch ran off Sept. 22, 2011, after the officers approached him and two other men. A subsequent chase ended with Berdel shooting Deloatch.

Officials say Deloatch threatened the officers with a board. The family says he was unarmed.

Deloatch's sons say they're devastated.

Kaplan says the grand jury met for 11 consecutive weeks, heard 57 witnesses, and reviewed 280 exhibits.

Kaplan says the case will undergo an administrative review by the police department.

A lawyer for the family says Kaplan hasn't assured them that steps have been taken to prevent similar incidents.

Homicide charge filed in New Jersey man's death

AP  Eyewitness NewsHANOVER TOWNSHIP, N.J. -- A northern New Jersey woman who allegedly was driving under the influence when she hit and killed a pedestrian this weekend has been charged with vehicular homicide.

Bail was set Sunday at $100,000 cash for 32-year-old Vanessa E. Brown of Parsippany. She also faces numerous motor vehicle charges.

Morris County prosecutors say Brown was driving in Hanover Township when she lost control of her car around 1:45 p.m. Saturday and struck 49-year-old Ralph Politi Jr. of East Hanover.

Politi was standing by the driver's side door of his pickup truck, which was parked in a parking space parallel to the road.

After hitting Politi, Brown's car traveled another 60 feet through a parking lot before hitting some parked cars.

Authorities did not know Sunday if Brown had retained a lawyer.

Lawsuits filed over planned mega-mall

Web produced by Bob Monek, Eyewitness NewsMAHWAH, N.J. (WABC) -- Two lawsuits in two states have been filed to stop the building of a mall at the International Crossroads in Mahwah.

The plan is ambitious: surround the Sheraton Crossroads Hotel in Mahwah with retail shops including two big box stores, a movie theatre and a second hotel.

The plan is also controversial. A mile away, across the state line in Suffern, small businesses fear the worst. In a lawsuit filed on Friday, the village claims that Mahwah did not consider the economic, environmental and traffic impacts the development would have on the New York state community.

No comment from officials in Mahwah, but the proposed crossroads town center cleared a big hurdle in March when council members voted to re-zone the area. Developers say the project would create jobs and millions in tax revenue.

Suffern Mayor Dagan LeCorte claims Mahwah's environmental study didn't take into account the impact on traffic in his village of 11-thousand residents. Flooding is also a major concern. Opponents of the plan say paving over 140 acres would worsen conditions in what is already a flood-prone area.

And there's opposition on the other side of the border. A group of Mahwah residents filed another lawsuit aimed at killing the project, which needs final approval from the planning council.
