Father charged with fatally tossing tot into creek

  Eyewitness NewsFREEHOLD, N.J. -- A man accused of tossing his 2-year-old daughter into a creek while she was still strapped in her car seat was indicted Monday on a murder charge.

Arthur Morgan III of Eatontown has been in jail on $10 million bail since his arrest in San Diego in November.

Tierra Morgan-Glover's body was found partially submerged in a park creek on Nov. 22. Prosecutors say Morgan had asked the girl's mother if he could take Tierra to see a movie about dancing penguins. When he didn't return her after a few hours, the mother called police.

In addition to the murder charge, Morgan is charged with interference with custody and child endangerment.

According to prosecutors, Morgan tossed the car seat, with his daughter strapped snugly inside its protective belts, from an overpass into the chilly water of the creek. To ensure that it sank, he had attached a car jack, the heavy metal contraption used to raise a car's chassis to change a flat tire.

Her cause of death was listed as "homicidal violence, including submersion in water." An autopsy determined that the child was alive when she hit the water.

Morgan's public defender declined to comment Monday.

Should Morgan be convicted, prosecutors say they will seek to have him imprisoned for the rest of his life without parole - the harshest punishment available in New Jersey since state officials instituted a moratorium on new death penalty cases several years ago.

An arraignment date in Superior Court hasn't yet been scheduled.

Father of arrested Morristown teen speaks out

MORRISTOWN (WABC) -- Milton Conway is doing what any father would do - protecting his son - until now. A mug shot of the 19-year-old after he was arrested and charged with lying to police in connection with 15-year-old Lennon Baldwin's suicide.

Investigators say Baldwin killed himself after a month of terror. Two underage students at Morristown High Schoolare charged with assault robbery and making terroristic threats.

Milton's son is not accused of touching Baldwin, just lying to police about the other two teens who did. Since he is an adult in the eyes of the law, his face has become the only one connected to the bullying headlines. Now he's getting online threats that read, "Justice would be to rob him and kill him. Someone said they are still lynch mobs down south."

These threats were serious enough for the school to ban him from campus for his own safety and the safety of others. This means no prom and no graduation.

Eyewitness News has word that Baldwin's parents are preparing to file a wrongful death lawsuit against the Board of Education. They are wondering if the district followed the strict state anti-bullying guidelines.

The school says it is conducting a review that will include an examination of all policies and procedures that deal with harassment, intimidation and bullying as well as an examination of the timely implementation of these procedures.

In the meantime, Milton just wants his son's roll to be put in context.

Father 'wires' son to capture teachers making fun of him

  Eyewitness NewsCHERRY HILL, New Jersey (WABC) -- A disturbing story from a New Jersey School where a dad, concerned about how his young autistic son was being treated, sent the child to school wearing a wire.

The boy came home with a shocking tape, full of abusive comments from teachers.

Stuart Chaifetz did what any other parent would do if they found out their child was being mistreated.

"When i heard what they had done to him - my life just shattered," said Chaifetz.

He posted a video on YouTube after discovering the very same people who were suppose to be caring for and protecting his son at a Cherry Hill school, were doing just the opposite.

His 10-year-old son Akian is autistic, and started classes in September.

Shortly after teachers began sending notes home to Stuart saying his son was being violent in class.

"I didn't understand it because he is such a gentle person, it was only happening at school," his father adds.

Stuart had several meetings with the school but still had no answers.

So he took a drastic step, wired his son up with this recording device.

He couldn't believe what he was hearing, remember his little boy is in the very same room where one staff begins by talking about heavy drinking the night before.

"You know what i was doing this morning? Heaving. Oh my god, so bad. The wine won," you could hear on the tape.

Things then take an ugly turn, Stuart says, the women turn on his son, berating him for talking to himself.

"Who are you talking to? Nobody? Knock it off," you hear.

And when Akian cries, "Go ahead and scream because guess what, you're going to get nothing until your mouth is shut. Shut your mouth."

After more tears you can hear someone call Akian a bastard.

The school district says it carried out a "Thorough and rigorous investigation. Responded swiftly and appropriately and that the individuals who are heard on the recording raising their voices and Inappropriately addressing children no longer work in the district..."

Father killed after tree falls on tent

  Eyewitness NewsNEW JERSEY (WABC) -- A father was killed and his wife critically injured when a large tree fell onto their campsite in New Jersey.

Miraculously, three children who were also in the tent were spared.

The giant Sycamore tree, standing 50 to 75 feet tall and estimated to weigh thousands of pounds, fell onto the tent just after 6 a.m. The father, 46-year-old William Arias, was pronounced dead at the scene, and his wife, 42-year-old Elcetia Arias, was rushed to the hospital in critical condition. Elcetia Arias's condition has since been upgraded to guarded.

The couple's 9-year-old son and 12-year-old daughter, as well as the children's 10-year-old male cousin, escaped injury.

"It was just luck they were in the right part of the tent to escape injury," one official said.

The three children were put in the custody of child services.

The family was from Somerset County and camping in an approved location at Bull's Island Recreation Area in Hunterdon County, near the Delaware River.

New Jersey Department of Environmental Protection spokesman Larry Ragonese compared the likelihood of something like this happening to being struck by lighting.

"There were no weather conditions," he said. "There was very light winds. There was no rain. There were no storms. There was nothing that occured other than the tree decided to uproot from the forest."
